ROXAS CITY, Capiz— The Commission on Election (Comelec) has dismissed the petition for disqualification filed by a barangay tanod of Cabug-Cabug in Pres. Roxas, Capiz against the incumbent town mayor.
The Comelec Second Division junked the case filed by Ronilon Ballon against Mayor Receliste “Tanoy” Escolin for lack of merit.
The poll body said the petition is shaky as it was filed after the respondent was proclaimed winner in the election.
The decision was issued on May 21, 2019, a week after Escolin was proclaimed on May 14, 2019.
Under Section 3, Rule 25 of Comelec Resolution No. 9523, any petition for disqualification should be filed before the candidate was proclaimed.
Escolin is serving his second term as mayor.
Ballon filed the petition after the mayor’s brother, Badiangon barangay captain Renboy Escolin, and some security agents of the mayor, allegedly harassed them.
